1. Definitions
- "Workshop" / "We" / "Us" / "Our" — Cogwright, operating from 88 Jalan Tun Abdul Razak, 80000 Johor Bahru, Johor, Malaysia.
- "Services" — Watch and clock repair, restoration and related bench work carried out by the Workshop.
- "Client" / "You" — Any individual who enquires about, commissions or collects Services from the Workshop.
- "Intake Record" — The written condition survey and service agreement created at the time a piece is accepted into the Workshop.
- "Agreement" — These Terms & Conditions together with any Intake Record signed or accepted by the Client.
2. Acceptance of Terms
By submitting a web enquiry, bringing a piece into the Workshop for assessment, or authorising us to proceed with any service, you confirm that you have read and agree to these Terms & Conditions. You must be 18 years of age or older and have the legal capacity to enter into a binding agreement. If you are bringing a piece on behalf of another person, you confirm that you are authorised to do so.
3. Service Description
The Workshop provides bracelet and strap bench work, chronograph movement servicing, and clock and pocket watch restoration. Services are carried out at the Workshop premises in Johor Bahru. The Workshop operates Monday to Friday 9:00 am – 6:00 pm and Saturday 10:00 am – 4:00 pm, and reserves the right to adjust opening hours without advance notice. Services are generally available to clients in Malaysia; postal arrangements may be discussed on a case-by-case basis.
4. Service-Specific Terms
4.1 Intake and scope agreement
All pieces are assessed on arrival. A written Intake Record is created documenting the condition of the piece and the proposed scope of work. No work proceeds without the Client's confirmation of scope and cost.
4.2 Changes to scope
If additional work is identified during the service, the Workshop will contact the Client before proceeding. Work beyond the agreed scope will not be carried out without explicit written or verbal confirmation. Where restoration is broken into stages, each stage is agreed separately.
4.3 Turnaround times
Estimated turnaround times are provided at intake. These are estimates, not commitments. Delays caused by parts availability, unexpected complexity or other factors will be communicated to the Client promptly.
4.4 Collection
The Client is notified when a piece is ready for collection. Pieces not collected within 60 days of notification may incur a storage charge. Pieces uncollected after 6 months may be disposed of in accordance with Malaysian law after reasonable attempts to contact the Client.
5. Payment Terms
All prices are quoted and payable in Malaysian Ringgit (MYR). Payment is due in full on collection unless a written deposit arrangement has been agreed in advance. Accepted payment methods include cash, bank transfer and major debit or credit cards. Parts costs beyond consumables included in the standard service scope are itemised separately and agreed before ordering. No refund is available for services already carried out, except where the Workshop has materially failed to complete the agreed scope.
6. Client Responsibilities
- You must have the right to authorise repair or restoration of any piece brought to the Workshop (i.e. you must be the owner or have the owner's authorisation).
- You are responsible for disclosing any known defects, previous repairs or modifications that may affect the service.
- You are responsible for providing accurate contact details so the Workshop can reach you during the service period.
- You must not submit pieces that are subject to legal restrictions on ownership or transfer.
7. Intellectual Property
All content on our website — including text, design elements, photographs and Workshop documentation formats — is the property of Cogwright and may not be reproduced without our written permission. Service records and photographs produced by the Workshop during your service become part of your intake file; a copy is provided to you, and the Workshop retains copies for its records.
8. Disclaimers
The Workshop will carry out agreed services with reasonable skill and care. However, antique and vintage movements carry inherent risks — parts may be brittle, original tolerances may be beyond practical recovery, and the condition of a movement can reveal further issues only once disassembly begins. The Workshop will always advise before proceeding if an unexpected condition is found. We make no representation that a particular rate accuracy, strike precision or cosmetic outcome will be achieved, and any outcome descriptions in our marketing materials are illustrative of typical results, not specific commitments.
9. Limitation of Liability
To the extent permitted by Malaysian law, the Workshop's total liability to you in connection with any service shall not exceed the amount paid by you for that service. We are not liable for indirect, consequential or special losses, including loss of use of the piece or any sentimental value. Nothing in these Terms excludes or limits liability for death, personal injury or fraud caused by our negligence.
10. Indemnification
You agree to indemnify the Workshop against any claim, loss or expense arising from your breach of these Terms, including your representation that you are entitled to authorise service on the piece in question.
11. Termination of Service
You may withdraw a piece from the Workshop at any time before work begins at no charge. Once work has begun, you are liable for the cost of work carried out to the point of withdrawal. The Workshop may decline to continue work on a piece if it becomes apparent that the piece cannot be safely serviced, if you are in breach of these Terms, or if the originally agreed scope has become impractical.
12. Dispute Resolution
These Terms are governed by the laws of Malaysia. In the event of a dispute, the parties agree to first attempt resolution by direct discussion. If no resolution is reached within 30 days, either party may refer the matter to the appropriate court in Johor Bahru, Malaysia, which shall have exclusive jurisdiction. Clients may also refer consumer complaints to the Tribunal for Consumer Claims Malaysia (Tribunal Tuntutan Pengguna Malaysia) where applicable under the Consumer Protection Act 1999.
13. General Provisions
These Terms, together with the Intake Record, constitute the entire agreement between you and the Workshop in relation to any service. If any part of these Terms is found to be unenforceable, that part shall be severed and the remainder shall continue in effect. A failure by the Workshop to enforce any provision is not a waiver of that provision. You may not assign your rights under any service agreement without our written consent.
14. Changes to These Terms
We may revise these Terms at any time. The version published on our website at the time you commission a service will apply to that service. Continued use of our website or services after any revision indicates your acceptance of the updated Terms.
